Idaho Legislative Update - 2008

S.B. 1395  Idahoans Who Reach Lifetime Benefit Maximum Eligible for High Risk Pool 

In 2000, the Idaho legislature created the Idaho High Risk Pool.  The purpose of the High Risk Pool was to provide every Idahoan who has serious health conditions an opportunity to purchase insurance through a reinsurance mechanism.  The original bill prohibited individuals who currently had insurance from applying to the High Risk Pool. 

An inadvertent result is that individuals who reach their lifetime maximum cannot apply for the High Risk Pool until their coverage is terminated.  This causes the person to go through a period of being uninsured, while building large dollars in claims.

This bill attempts to remedy this situation by allowing an individual who would otherwise qualify for the High Risk Pool to apply for coverage if there is reasonable probability that they will exceed their lifetime maximum within 90 days.

This bill goes into effect July 1, 2008
